What is the Aggravating Circumstance of "Adversely Affecting Security, Order, and Social Safety" in Corruption Crimes?
Based on Clause 4, Article 4 of Resolution 03/2020/NQ-HDTP stipulated as follows:
- The circumstance "causing adverse effects on security, order, and social safety" as specified in Clause 3 of Articles 353 and 355 of the Criminal Code is one of the following cases:
+ Inciting mass petitions, demonstrations, and disturbances that hostile forces exploit, recruit, and provoke to oppose the government, distort the Party's line, policies, and laws of the state;
+ Causing confusion, fear, or outrage among the people;
+ Creating difficulties in implementing the Party's line, policies, and laws of the State.
Example: Nguyen Van A embezzled funds intended to support the poor in economic development, causing the People's Committee of Commune B to encounter difficulties in implementing local poverty eradication policies.
