Pursuant to Article 5 of the Law on Drug Prevention and Control 2021, prohibited acts in drug prevention and control include:
- Cultivating plants containing narcotic substances, instructing the cultivation of plants containing narcotic substances.
- Research, appraisal, testing, inspection, production, storage, transportation, preservation, trading, distribution, handling, exchange, export, import, temporary import, re-export, temporary export, re-import, illegal transit of narcotics, precursors, addictive drugs, psychotropic drugs, precursor drugs, raw materials for producing addictive drugs, psychotropic substances, precursors used in medicines, veterinary drugs containing narcotics, precursors.
- Appropriation of narcotics, precursors, addictive drugs, psychotropic drugs, precursor drugs, raw materials for producing addictive drugs, psychotropic substances, precursors used in medicines, veterinary drugs containing narcotics, precursors.
- Delivery, management, control, storage, issuance, preservation of narcotics, precursors against legal regulations; permitting the use of narcotics, addictive drugs, or psychotropic drugs against legal regulations.
- Using, organizing the illegal use of narcotics; forcing, enticing others to illegally use narcotics; sheltering, supporting the illegal use of narcotics.
- Producing, storing, transporting, trading in equipment, tools used for the production or illegal use of narcotics.
- Resisting or obstructing drug tests in the body, determining addiction status, managing illegal drug users, drug detoxification, management after detoxification.
- Retaliating against or obstructing individuals performing anti-drug duties, individuals participating in drug prevention.
- Exploiting positions, powers, or professions to violate laws on drug prevention and control.
- Instructing the illegal production, use of narcotics; advertising, marketing narcotics.
- Stigmatizing illegal drug users, those undergoing detoxification, individuals post-detoxification.
- Other prohibited acts as prescribed by laws relating to narcotics.
When is drug testing conducted on individuals in Vietnam?
Pursuant to Article 22 of the Law on Drug Prevention and Control 2021, drug testing in the human body is regulated as follows:
Article 22. Drug testing in the human body
- Drug testing in the body is conducted for individuals in the following cases:
a) Individuals found illegally using narcotics;
b) Individuals that authorities or competent persons have grounds to believe are engaged in illegal drug use;
c) Individuals illegally using narcotics within the management period;
d) Individuals subject to administrative handling measures for education at commune, ward, or commune-level town for illegal drug use; undergoing drug detoxification; being treated for opioid addiction with substitution drugs; under management after drug detoxification.
- Heads of drug detoxification centers, facilities treating opioid addiction with substitution drugs; individuals authorized to impose administrative sanctions for illegal drug use conduct drug testing or request organizations, professionals to conduct drug testing for cases specified in Clause 1 of this Article.
