What is Indecent Assault?
Based on Clause 3, Article 3 of Resolution 06/2019/NQ-HDTP, the regulation is as follows:
- Lewd acts as stipulated in Clause 1, Article 146 of the Criminal Code are actions by individuals of the same or different gender involving physical contact, either directly or indirectly through clothing, with the genitalia, sensitive parts, or other parts of the body of a person under 16 years old, which have a sexual nature but are not intended for sexual intercourse, including one of the following actions:
+ Using genitalia or sensitive parts to make contact (e.g., touching, rubbing, grinding...) with the genitalia, sensitive parts, or other parts of a person under 16 years old;
+ Using other parts of the body (e.g., hands, feet, mouth, tongue...) to make contact (e.g., caressing, touching, squeezing, pinching, kissing, licking...) with the genitalia or sensitive parts of a person under 16 years old;
+ Using sexual devices to make contact (e.g., touching, rubbing, grinding...) with the genitalia or sensitive parts of a person under 16 years old;
+ Inducing or forcing a person under 16 years old to use their body parts to make contact (e.g., caressing, touching, squeezing, pinching, kissing, licking...) with the sensitive parts of the perpetrator or another person;
+ Other actions of a sexual nature but not intended for sexual intercourse (e.g., kissing on the mouth, neck, ears, nape... of a person under 16 years old).
