What is Criminal Prosecution?
Based on the provisions of the Penal Code 2015, it can be observed: Criminal liability is the obligation of the offender to bear criminal responsibility for the criminal acts they have committed. In other words, it is the application of criminal procedural measures through various stages from initiating the case, prosecuting the accused, to investigating, prosecuting, and adjudicating to compel the person who has committed a socially dangerous act, as defined by the Penal Code, to be responsible for that act, which means receiving a penalty. A person who is capable of understanding their actions and capable of controlling said actions is a person with criminal liability capacity and will be subject to criminal responsibility if that person commits a socially dangerous act as specified in the Penal Code.
