A serious violation of criminal procedure is when an agency or an authorized person conducting the proceedings during the stages of prosecution, investigation, prosecution, or trial fails to implement or incorrectly or inadequately implements the order and procedures stipulated by this Code, which severely infringes on the rights and legitimate interests of the participants in the proceedings or affects the comprehensive, objective determination of the truth of the case.
