What are the penalties for involuntary infliction of bodily harm upon others in Vietnam?

How shall people, who involuntary inflicts bodily harm upon others in Vietnam, face criminal liabilities?

Pursuant to Article 138 of the Criminal Code in 2015 (amended by the Law on amendments to the Criminal Code in 2017) stipulating involuntary infliction of bodily harm upon others in Vietnam as follows:

1. Any person who involuntarily inflicts 31% - 60% WPI to another person shall receive a warning, be liable to a fine of VND 5,000,000 - VND 20,000,000 or face a penalty of up to 01 year’s community sentence.

2. This offence committed in any of the following circumstances carries a penalty of 01 – 02 years’ community sentence or 03 – 24 months’ imprisonment:

a) The offence results in bodily harm of 02 or more people, each of whom suffers from 31% - 60% WPI;

b) The offence causes ≥ 61% WPI for the victim.

3. If this offence results in bodily harm of 02 or more people, each of whom suffers from ≥ 61% WPI, the offender shall face a penalty of 02 – 03 years’ community sentence or 01 - 03 years' imprisonment.

As regulations above, the penalties shall depend on how serious of the WPI that the victims.

If you involuntarily inflicts bodily harm upon others in Vietnam but not liable to criminal prosecution, you shall face administrative penalties.

What are administrative penalties for involuntary inflicts bodily harm upon others in Vietnam?

Pursuant to Clause 1 Article 7 of the Decree 144/2021/NĐ-CP, a warning or a fine ranging from 300.000 VND to 500.000 VND shall be imposed for any of the following violations:

- Disrupting order at a place with ongoing art performance, sports activities, commerce, office buildings, residential areas or other public places, except the cases specified in Point a Clause 2 and Point b Clause 5 of this Article;

- Allowing domestic animals to run off-leash in an urban area or public area;

- Allowing domestic animals, plants or other items to occupy the road surface, sidewalk, public park, playground, urban area or public area in a residential area or urban area;

- Unintentionally causing injuries or bodily harm to another person but not liable to criminal prosecution;

- Throwing or putting any other item on the perimeter walls and adjacent areas of the protected area;

- Raising, grazing livestock and poultry in an apartment building

As regulations above, a warning or a fine ranging from 300.000 VND to 500.000 VND shall be imposed for unintentionally causing injuries or bodily harm to another person but not liable to criminal prosecution.
