Hello Lawnet. My husband and I are living peacefully. Howver, after a day of drinking, my hushand's friend spoke badly on me and incited my husband to teach his wife. Then, my husband beat me when he returned home. What are the fines imposed on that friend for urging my husband to commit domestic violence acts?

What are the fines for urging other persons to commit domestic violence acts in Vietnam?
Pursuant to Article 8 of the Law on Domestic Violence Prevention and Control in 2007 stipulating acts strictly forbidden as follows:
1. Domestic violence acts defined in Article 2 of this Law.
2. Forcing, provoking, urging and enabling other persons to commit domestic violence acts
3. Using and diffusing information, images and sounds to provoke domestic violence acts
4. Revenging or threatening to revenge the people who help the victims of domestic violence, discover, report and prevent the domestic violence acts.
5. Obstructing the discovery, reporting and settlement of domestic violence acts.
6. Making use of domestic violence prevention and control to make profits or to carry out other illegal activities.
7. Complicity, covering up, avoiding settlement and mis-settlement of domestic violence acts and non-compliance with the Law.
Pursuant to Article 61 of the Decree 144/2021/NĐ-CP stipulating regulations on forcing, inciting, instigating and enabling others to commit acts of domestic violence as follows:
1. A fine of between VND 5.000.000 and 10.000.000 shall be imposed for coercing, inciting, instigating and enabling others to commit acts of domestic violence;
2. A fine of between VND 10.000.000 and 20.000.000 shall be imposed for forcing others to commit acts of domestic violence;
As regulations above, the friend of your husband shall face a fine of between VND 5.000.000 and 10.000.000 for urging other persons to commit domestic violence acts in Vietnam.
Is there any imprisonment sentence imposed on anyone committing domestic violence acts in Vietnam?
Pursuant to Article 185 of the Criminal Code in 2015 stipulating maltreatment or abuse of one's grandparent, parent, spouse, child, grandchild or caregiver as follows:
1. Any person who maltreats or commits violent acts against his/her grandparent, parent, spouse, child, grandchild or caregiver in any of the following circumstances shall receive a warning, face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment:
a) The victim suffers from regular physical and mental pain;
b) The offender has incurred an administrative penalty for the same offence.
2. This offence committed in any of the following circumstances carries a penalty of 02 - 05 years' imprisonment:
a) The offence is committed against a person under 16, a woman with the full knowledge of her pregnancy or an old and weak person;
b) The offence is committed against a person with severe or extremely severe disabilities or a person having a fatal disease.
As regulations above, if you husband usually beat you and repeat the violation many times despite being fined, he shall receive a warning, face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment.
What are prevention and protection measures for victims of domestic violence in Vietnam?
Pursuant to Article 19 of the Law on Domestic Violence Prevention and Control in 2007 stipulating prevention and protection measures for victims of domestic violence in Vietnam as follows:
1. Prevention and protection measures shall be applied to protect the victim of domestic violence, stop violent acts and minimize the consequences of domestic violence, including:
a) Stopping domestic violence acts;
b) Making first aid arrangements for the victim of domestic violence;
c) Taking preventive measures in accordance with the Law in dealing with the violations of civil and criminal nature applicable to the person committing domestic violence;
d) The person committing violent acts shall not be allowed to approach the victim and not to use telephone or other medium to get in touch with the victim in order to commit violence (hereinafter referred to as a measure of forbidden contact);
2. The person present at the scene of violence, depending on the severity of the violent acts and their ability, shall be reponsible for taking measures referred to in points a and b, paragragh 1 of this Article;
3. Authority and conditions for the application, change and cancelation of measures referred to in point c, paragragh 1 of this Article shall be in accordance with the legislation on dealing with violations of civil or criminal nature;
4. The application of measures stipulated in point d, paragragh 1 of this Article shall comply with Articles 20 and 21 of this Law.
Above are prevention and protection measures applied to protect the victim of domestic violence, stop violent acts and minimize the consequences of domestic violence.
