What are rights and obligations of complainants in sending drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam?

Pursuant to Article 44 of the Ordinance on Orders and Procedures for People's Courts to consider and decide to send drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam stipulating as follows:

1. Complaining agencies, organizations and individuals have the following rights:

a) Send complaints by themselves or through a legal representative;

b) Send complaints during any stage of the process of considering and deciding to send to a compulsory detoxification establishment;

c) Withdraw the complaint at any stage of the complaint settlement process;

d) Receive a written reply on the acceptance to settle the complaint, receive the decision on complaint settlement;

d) Have their legitimate rights and interests restored, and to be compensated for damage in accordance with law.

2. Complaining agencies, organizations and individuals have the following obligations:

a) Send complaints to the right person competent to settle;

b) Honestly present the facts and provide information and documents to the complaint settler; take responsibility before law for the content presented and the provision of such information and documents;

c) Abide by the legally effective complaint settlement decision.

Pursuant to Article 45 of the Ordinance on Orders and Procedures for People's Courts to consider and decide to send drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam stipulating as follows:

1. The complained person has the following rights:

a) Provide evidence of the legitimacy of the act complained of;

b) Receive the complaint settlement decision about the complained act.

2. The complained person has the following obligations:

a) Explanation of the complained act; provide relevant information and documents at the request of a competent person;

b) Abide by the legally effective complaint settlement decision;

c) Compensate for damage and remedy consequences caused by their illegal acts in accordance with law.

What is the time limit for making complaints about sending drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam?

Pursuant to Article 46 of the Ordinance on Orders and Procedures for People's Courts to consider and decide to send drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam stipulating as follows:

The time limit for making a complaint is 3 working days from the date the complaining agency, organization or individual learns of the behavior of the competent person that the complainant thinks is illegal.

If the complaining agency, organization or individual is unable to exercise the right to complain within the time limit specified in this Article due to a force majeure event or an objective obstacle, the time of occurrence of the force majeure event or that objective obstacle does not count towards the time limit for complaints.

What are regulations on competence and time limit for settling complaints in sending drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam?

Pursuant to Article 47 of the Ordinance on Orders and Procedures for People's Courts to consider and decide to send drug addicts from full 12 to under 18 years old to compulsory rehabilitation establishments in Vietnam stipulating as follows:

1. Complaints about acts of judges or court clerks shall be settled by the chief justices of district-level people's courts within 03 working days from the date of receipt of complaints; if disagreeing with the settlement result, the complainant has the right to lodge a complaint with the competent provincial-level People's Court. Within 05 working days from the date of receipt of the complaint, the Chief Justice of the People's Court of the province must consider and settle it. The decision of the Chief Justice of the People's Court of the province is legally effective.

Complaints about acts of the Chief Justice of the district-level People's Court shall be settled by the Chief Justice of the provincial-level People's Court within 05 working days from the date of receipt of the complaint. The decision of the Chief Justice of the People's Court of the province is legally effective.

2. Complaints about acts of judges and clerks of the provincial-level People's Courts shall be settled by the Chief Justices of the provincial-level People's Courts. Within 03 working days from the date of receipt of the complaint, the Chief Justice of the People's Court of the province must consider and settle it. The decision of the Chief Justice of the People's Court of the province is legally effective.

3. Complaints about acts of the Chief Justice of the Provincial People's Court shall be considered and settled by the Chief Justice of the Superior People's Court within the territorial jurisdiction within 03 working days from the date of receipt of complain. The decision of the Chief Justice of the Supreme People's Court is legally effective.

4. Within 02 working days from the date of issuance of the decision, the Court must send the complaint settlement decision to the agency, organization or individual that has complained and the Procuracy of the same level.
