Article 18 of the Regulations on administrative work of the Vietnamese Social Insurance sector, issued together with Decision 3012/QĐ-BHXH in 2022, stipulates the organization of draft review in the administrative work of the Vietnamese Social Insurance sector as follows:

1. Responsibilities of the reviewing unit and the unit submitting the review dossier

a) Responsibilities of the reviewing unit:

The Legal Department receives and checks the review dossier. If the dossier is incomplete, the Legal Department requests the unit responsible for drafting the document to supplement it. The Legal Department reviews the content of the documents issued by the Vietnamese Social Insurance Authority in accordance with the provisions of Article 16 of this Regulation. The Legal Department then forwards the review opinion to the unit responsible for drafting the document for feedback, supplementation, and completion of the dossier for submission to the Sector's leaders.

The Provincial Social Insurance Office reviews the documents according to the guidance on the implementation of the legal work of the Vietnamese Social Insurance Authority.

The reviewing unit directly exchanges with the drafting unit on issues that need to be clarified or issues that need to be amended or supplemented. The reviewing unit may request the drafting unit to provide information and documents related to the draft document if necessary. In the event that the reviewing unit and the drafting unit cannot reach an agreement, the reviewing unit has the right to reserve its opinion and report to the Sector's leaders.

b) Responsibilities of the unit submitting the review dossier:

Submit the review dossier in full in accordance with the provisions of Article 17 of this Regulation.

Coordinate and provide information to the reviewing unit on issues that need to be clarified.

2. Deadline for review

The deadline for reviewing a draft document is no more than 7 working days (calculated from the date of receiving a complete dossier), except in the case of a draft document with complex content or a document that needs to shorten the review time according to the direction of the Sector's leaders.

Article 19 of the Regulations on administrative work of the Vietnamese Social Insurance sector, issued together with Decision 3012/QĐ-BHXH in 2022, stipulates the file for signing documents in the administrative work of the Vietnamese Social Insurance sector as follows:

1. Documents and materials as prescribed in Clauses 2, 3, 4, 5, 6, 7, 8, 9 of Article 17 of this Regulation.

2. The opinion of the reviewing unit (if any)

3. The draft document of previous versions (if any)

What are regulations on abbreviation of draft documents in the administrative work of the Vietnamese Social Insurance sector?

Article 20 of the Regulations on administrative work of the Vietnamese Social Insurance sector, issued together with Decision 3012/QĐ-BHXH in 2022, stipulates the following on the file for signing documents in the administrative work of the Vietnamese Social Insurance sector:

1. The drafting unit

a) Documents signed by the General Director or Deputy General Director: The head of the drafting unit signs the draft document.

b) Documents signed by the heads of affiliated units or the Director of the Provincial Social Insurance Agency: The head of the department that drafted the document signs the draft document; for units without a department level, the individual assigned to draft the document signs.

c) Documents signed by the Director of the District Social Insurance Agency: The head of the business unit or the individual assigned to draft the document signs (if there is no business unit).
The signature is signed at the end of the document content (after the ./.); the size does not exceed 0.5 cm2.

2. The Office

a) For work files submitted for processing in paper form, the Office checks the procedures, dossiers; format, presentation techniques. The head of the Office signs the draft document before submitting it to the head of the agency, if the document is signed by the head of the agency; signs the draft document before issuing, if the document is signed by the head of the unit by proxy.
The position of signature after the dot (.) at the end of the “Recipient” section; the size does not exceed 0.5 cm2.

b) For work files submitted for signature on the Document Management System, the Office does not perform the signature of the draft document.
