Voluntary Rehabilitation: Is Administrative Penalty Imposed for Illegal Drug Use?
Is Voluntary Rehabilitation Subject to Administrative Sanctions for Illicit Drug Use?
Pursuant to Article 32 of the Law on Drug Prevention and Control 2021, regulations on Subjects Subject to Administrative Measures for Compulsory Rehabilitation in Rehabilitation Centers:
Drug addicts aged 18 years and older are subject to administrative measures for compulsory rehabilitation in rehabilitation centers in accordance with the Law on Handling of Administrative Violations when falling into one of the following cases:
Failing to register, failing to implement, or voluntarily terminating voluntary drug rehabilitation;
During the period of voluntary drug rehabilitation, being discovered using illicit drugs;
Drug addicts using opiate substances failing to register, failing to implement, or voluntarily terminating the treatment of opioid dependence with substitute medications or being terminated from the treatment due to violations of regulations on addiction treatment;
During the post-rehabilitation management period, relapsing into drug use.
Thus, according to current regulations, if you voluntarily notify the competent authorities of your drug use and voluntarily undergo rehabilitation, you will not be subject to administrative sanctions for this behavior.
Could Rehabilitation Fees Be Reduced in Case of Financial Hardship?
According to Article 31 of this Law, the regulation on voluntary drug rehabilitation in rehabilitation centers is as follows:
The duration of voluntary drug rehabilitation in rehabilitation centers is from 06 months to 12 months.
Individuals undergoing voluntary drug rehabilitation in rehabilitation centers who complete at least 03 stages specified in points a, b, and c of clause 1 Article 29 of this Law shall be supported financially.
Individuals undergoing voluntary drug rehabilitation in rehabilitation centers have the following responsibilities:
a) Comply fully and accurately with the regulations on voluntary drug rehabilitation and adhere to the guidance of specialized agencies;
b) Pay the costs related to drug rehabilitation as prescribed.
In case individuals undergoing voluntary drug rehabilitation in public rehabilitation centers face financial hardship, they may be considered for cost reduction or exemption.
Rehabilitation centers are responsible for issuing certificates of completion of voluntary drug rehabilitation to individuals.
The Government of Vietnam regulates this Article in detail.
Thus, according to current regulations, if you register for voluntary rehabilitation at a public rehabilitation center and face financial hardship, you will be considered for cost reduction or exemption.
