Vietnam: Is it allowed to visit a loved one who is an inmate?
According to Article 4 Circular 14/2020/TT-BCA, the regulation on those allowed to visit inmates in Vietnam is as follows:
- Relatives allowed to visit inmates include paternal grandparents; maternal grandparents; biological parents; parents-in-law (or parents-in-law of the spouse); legally adoptive parents; spouse; biological children, daughters-in-law, sons-in-law, legally adopted children; biological siblings, siblings-in-law; siblings of the spouse; aunts, uncles, uncles-in-law, nieces, and nephews. Each visit to the inmate can include a maximum of 03 relatives. In special cases, based on the requirements of education and correction, the head of the detention facility may decide to increase the number of relatives visiting the inmate. Still, not more than 05 people, ensuring that the visitation does not affect the security and safety of the detention facility.
- In the case where representatives of agencies, organizations, or other individuals request to visit inmates, the head of the detention facility in Vietnam will consider and resolve if deemed suitable with the lawful interests of the inmate, as well as the requirements of management, education, correction of the inmate, and crime prevention.
Thus, under the above regulations, the lover does not fall under the categories classified as relatives. Therefore, you are not allowed to visit the inmate. However, you may request the head of the detention facility to consider if it aligns with the lawful interests, the management and correctional education requirements, and crime prevention. If deemed appropriate, you will be allowed to visit the inmate.
