Use of Knives and Machetes to Disturb Public Order: How Many Years of Imprisonment?
Pursuant to Point b, Clause 2, Article 318 of the 2015 Penal Code stipulating the Crime of Disturbing Public Order as follows:
Any person who disturbs public order causing adverse effects on security, order, social safety, or has already been administratively sanctioned for this act or has been convicted of this crime, has not had their criminal record expunged but continues to commit violations, shall be fined from 5,000,000 VND to 50,000,000 VND, subjected to non-custodial reform for up to 2 years, or imprisoned from 3 months to 2 years.
An offense committed under one of the following circumstances shall be subject to imprisonment from 2 years to 7 years:
- In a structured manner;
- Using weapons, dangerous tools, or engaging in acts of vandalism;
Therefore, the act of using knives, machetes is considered as using weapons, dangerous tools and engaging in acts of disrupting public order depending on the nature of which may apply the highest imprisonment sentence of up to 7 years.
