Unlawful Trespassing into Another Person’s Residence May Lead to Imprisonment for Up to 2 Years?
The act of unlawfully trespassing on another person's residence will be prosecuted under criminal liability for the Crime of Infringing upon Another Person's Residence according to the provisions of Article 158 of the Criminal Code 2015, amended by Clause 31 Article 1 of the Law on Amendments to the Criminal Code 2017, specifically:
- Anyone who commits one of the following acts infringing upon another person's residence shall be subject to non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years:
a) Unlawfully searching another person's residence;
b) Unlawfully evicting another person from their residence;
c) Illegally occupying the residence or unlawfully preventing a person who is legally residing or managing the residence from entering;
d) Unlawfully trespassing on another person's residence.

Thus, in the case of unlawfully trespassing on another person's residence, if it does not fall under the circumstances specified in Clause 2, shall be subject to non-custodial reform for up to 2 years or imprisonment from 3 months to 2 years.
