Unfulfilled Compensation for Damages: Eligibility for Amnesty?
According to Clause 1, Article 11 of the Amnesty Law 2018, one of the conditions for amnesty is the completion of additional penalties such as fines and court fee payments.
With the humanitarian spirit creating opportunities for offenders to reintegrate and for families facing difficulties, the conditions for amnesty according to the Amnesty Law 2018 have been supplemented with:
Having completed or partially fulfilled the obligation to return assets, compensate for damage, or other civil obligations but falling into particularly difficult economic circumstances, where there are no conditions to continue fulfilling the remaining parts according to the law on civil judgment enforcement for those sentenced to imprisonment not belonging to the cases specified in point d of this clause.
In cases where the obligation to return assets, compensate for damage, or other civil obligations regarding assets not owned by the State must be fulfilled, the person entitled to the judgment enforcement must agree to suspend the enforcement or not require the execution of this asset;
=>In some cases, such as financial hardship and inability to fulfill compensation or punishment, amnesty could be considered even if compensation is not fully completed. Naturally, this is not the only condition for being granted amnesty, as there are many other conditions as well.
