Two Cases of Exemption from Punishment for Crime
According to Article 59 of the 2015 Criminal Code, the provisions are as follows:
An offender may be exempt from punishment if they fall under any of the following cases deserving special clemency but not to the extent of exemption from criminal liability:
- The court may impose a penalty below the minimum level of the applicable penalty framework, but it must fall within the immediately lighter penalty framework of the statute when the offender has at least two mitigating circumstances as stipulated in the Criminal Code.
- The court may impose a penalty below the minimum level of the applicable penalty framework without having to be within the immediately lighter penalty framework of the statute for first-time offenders who are accessories in a joint offense but have an insignificant role.
=> Thus, according to this provision, an offender may be exempt from punishment if they meet the above conditions.
