The terminally ill with cancer will definitely be exempt from criminal liability?
Based on Clause 1, Clause 2b, Article 29 of the 2015 Criminal Code, the provisions are as follows:
- The offender shall be exempt from criminal liability under one of the following grounds:
- During investigation, prosecution, or trial, due to a change in policy or law, the criminal act is no longer dangerous to society;- When there is a decision of amnesty.
- The offender may be exempt from criminal liability under one of the following grounds:
- During investigation, prosecution, or trial, the offender has a terminal illness leading to the inability to pose a danger to society any longer.
Thus, if a person is in the terminal stage of cancer and the competent authority confirms that this person no longer has the ability to pose a danger to society, he/she may be exempt from criminal liability but is not automatically exempt from criminal liability.
