The Offender Being a Relative of a Person with Merits to the Revolution is Not a Mitigating Circumstance for Criminal Responsibility?
Point b Clause 6 Article 1 Law amending the Criminal Code 2017, Amending and Supplementing Point x Clause 1 Article 51 Criminal Code 2015 stipulates the following circumstance as a mitigating factor for criminal liability:
x) The offender is a person who has contributed to the revolution or is the father, mother, wife, husband, or child of a martyr.

According to Article 3 of the Ordinance on Preferential Treatment for Persons with Meritorious Services to the Revolution 2020, the father, mother, wife, husband, or child of a martyr is considered a relative of a person with meritorious services to the revolution. However, only this circumstance is considered a mitigating factor for criminal liability.
Other relatives of persons with meritorious services to the revolution will not be considered as a mitigating factor for criminal liability.
