Sentenced to 7 Years in Prison: Determining Whether It is a Serious Crime or a Particularly Serious Crime
According to Article 9 of the Penal Code 2015 (amended by Clause 2 Article 1 of the Law Amending the Penal Code 2017), the classification of crimes is stipulated as follows:
+ Serious crimes are those that have a significant nature and degree of danger to society, with the highest punishment frame stipulated by this Code for such crimes ranging from over 03 years of imprisonment to 07 years of imprisonment;
+ Very serious crimes are those that have a particularly significant nature and degree of danger to society, with the highest punishment frame stipulated by this Code for such crimes ranging from over 07 years of imprisonment to 15 years of imprisonment.
Thus, in this case, it is necessary to specifically determine the crime for which the individual is sentenced to 7 years of imprisonment according to the provisions of the Penal Code. After that, based on the highest punishment frame for that crime, and comparing it with the above-stated regulation, it will be possible to identify the type of crime.
