Regulations on Seizure and Preservation of Prohibited Items in Correctional Facilities
Based on Article 4 of Circular 10/2020/TT-BCA (effective from March 20, 2020) stipulating the seizure and preservation of prohibited items as follows:
- When detecting inmates, individuals, or organizations engaging in acts of bringing in, storing, or using prohibited items within detention facilities, the responsible officer must draft a violation report and temporarily seize the prohibited items, take statements from the violator and witnesses. The seizure report must accurately describe the condition, quantity, weight, type, shape, size, color, and other characteristics of the prohibited item, and seal the item (for items that require sealing).
- Seized prohibited items must be preserved intact, with a receipt report and fully recorded in documents, ensuring no loss or damage.
- The detention facility is responsible for arranging a storage warehouse and appointing officers to manage prohibited items according to regulations.
