Persons Concealing Crimes Are Not Subject to Criminal Liability
Based on Clause 2, Article 18 of the Penal Code 2015, it is stipulated as follows:
Any person who, without prior promise, but after knowing that a crime has been committed, conceals the offender, traces, evidence of the crime, or commits other acts obstructing the detection, investigation, and handling of the offender, shall bear the criminal responsibility for concealing a crime in the cases stipulated by this Code.
A person who conceals a crime, if they are the offender's grandfather, grandmother, father, mother, child, grandchild, sibling, wife or husband, shall not bear criminal responsibility according to Clause 1 of this Article, except in the case of concealing crimes violating national security or other particularly serious crimes stipulated in Article 389 of this Code.
Based on Clause 137, Article 1 of the Law amending the Penal Code 2017, which amends Clause 1, Article 389 of the Penal Code 2015, it is stipulated that hiding one of the following crimes will lead to criminal responsibility for concealing a crime, including concealing crimes stipulated in Clauses 2, 3 and 4, Article 173 of the Penal Code 2015.
In the above-mentioned case, the child who committed the crime is prosecuted under Clause 1, Article 173, so the father who conceals the child's criminal act will not be prosecuted.
