May a person whose relative has conviction apply to the Vietnam People's Public Security schools?
Regarding the principle, all types of crimes have convictions. However, after a certain period, if no further crimes are committed, the conviction will naturally be expunged.
According to Article 70 of the Criminal Code 2015:
The automatic expungement of convictions applies to individuals convicted of crimes not specified in Chapter XIII and Chapter XXVI of this Code when they have completed the principal penalty, probation period or the statute of limitations for the enforcement of the judgment, and meet the conditions stipulated in clauses 2 and 3 of this Article.
An individual is naturally eligible for the expungement of convictions if, from the time of completing the principal penalty or the end of the probation period, they have completed the supplementary penalty, adhered to other judgments, and have not committed new offenses within the following periods:
1 year in the case of a warning, fine, non-custodial reform, imprisonment but with a suspended sentence;...
...
Thus, from the date of completing the sentence (October 2021), after 1 year, your father will naturally have his conviction expunged, which is October 2022.
According to the regulations in Circular 15/2016/TT-BCA on admissions into schools under the Ministry of Public Security, there are no stipulations regarding the personal background of family members. Therefore, whether your father has a conviction or not does not affect your eligibility to apply to these schools.
However, due to the specific nature of the sector, there are many internal documents related to résumés, so you need to review the specific regulations for application.
Sincerely!
