Killing Due to Exceeding the Limits of Justifiable Defense: What is the Maximum Prison Sentence?
Article 126 of the Criminal Code 2015 stipulates the crime of murder exceeding the limits of legitimate defense or exceeding the necessary level when apprehending offenders as follows:
Anyone who commits murder in cases of exceeding the limits of legitimate defense or in cases of exceeding the necessary level when apprehending offenders shall be subject to non-custodial reeducation for up to 02 years or a prison term of 03 months to 02 years.
For offenses against 02 or more persons, the offender shall be subject to a prison term of 02 to 05 years.
Thus, for the crime of murder exceeding the limits of legitimate defense in the case of killing 01 person, the prescribed maximum prison sentence is 02 years; for 02 or more persons, the maximum prison sentence is 05 years.
