Is the Mandatory Medical Treatment Period Deductible from the Prison Sentence Term?
Regarding this issue, Clause 3 Article 49 of the Criminal Code 2015 provides as follows:
For a person serving a prison sentence who suffers from an illness to the extent that they lose the ability to perceive or control their behavior, based on the forensic examination conclusion or psychiatric forensic examination, the Court may decide to place them in a specialized treatment facility for compulsory treatment. After recovery, if there is no other reason to exempt from serving the sentence, the person must continue to serve the sentence.
The period of compulsory treatment is deducted from the duration of the prison sentence.
=> Thus, according to this provision, a person serving a prison sentence who is compelled to undergo treatment will have their treatment period deducted from the duration of their prison sentence.
