Is Tarot fortune telling a violation against the law of Vietnam? Is Tarot reader criminally prosecuted in Vietnam? What are the fines for Tarot fortune telling causing disruption to public order in Vietnam?
Hello Lawnet. T, my friend, is a Tarot reader. As Tarot is so familiar with the youth nowadays, I wonder if Tarot fortune telling is a violation against the law of Vietnam. What are the fines for this act?

Is Tarot fortune telling a violation against the law of Vietnam?
Pursuant to Clause 7 Article 14 of the Decree 38/2021/NĐ-CP stipulating violation against regulations on organization of festivals in Vietnam as follows:
7. Imposing the fine ranging from 15,000,000 dong to 20,000,000 dong for one of the following violations:
a) Organizing festivals that are subject to registration regulations without any written consent from competent state authorities;
b) Organizing traditional festivals of which historical and cultural nature and meaning are not correct;
c) Performing rituals that are violent, offensive, contrary to the traditional peace-loving and humanitarian tradition of Vietnam;
d) Failing to delay festivals at the request of the competent state authority;
dd) Organizing superstitious activities.
Pursuant to Clause 2 Article 5 of the Decree 38/2021/NĐ-CP stipulating as follows:
2. The amounts of fine specified in Chapter II and Chapter III of this Decree are imposed on individuals while those specified in clause 1, point c clause 4, point a clause 5 and 6 of Article 6; point c, dd, e and g clause 4 of Article 8; clause 1, 2 and 3 of Article 9; Article 10; point a clause 2, clause 3, 5 and 6, point a, b, c and d clause 7 Article 14; clause 1, 2, 3, 4 and point b clause 5 Article 21; clause 1, 2, 3, 4 and point b clause 5 Article 23; clause 1 of Article 24; Article 30, 38, 39 and 40 of this Decree are applicable to organizations.
As regulations above, Tarot fortune telling is not a violation against the law of Vietnam. It is only a violation if the reader misuses it to organize superstitious activities. Aynone who misuses Tarot fortune telling to organize superstitious activities shall be fined from 15,000,000 dong to 20,000,000 dong.
If your friend don't misuse Tarot to organize superstitious activities, he/she is not violating the law.
Is Tarot reader criminally prosecuted in Vietnam?
Pursuant to Article 320 of the Criminal Code in 2015 stipulating practicing superstitions in Vietnam as follows:
1. Any person who practices fortune-telling, witchcraft or other types of superstitions despite the fact that he/she has incurred an administrative penalty for the same offence or has an unspent conviction for the same offence shall be liable to a fine of from VND 10,000,000 to VND 100,000,000 or face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment.
2. This offence committed in any of the following circumstances carries a penalty of 03 - 10 years' imprisonment:
a) The offence results in the death of a person;
b) The illegal profit earned is ≥ VND 200,000,000;
c) The offence has a negative impact on social security, order or safety.
3. The offender might also be liable to a fine of from VND 10,000,000 to VND 50,000,000.
As regulations above, if the Tarot reader misuses it to organize superstitious activities, he/she will be criminally prosecuted. He/she shall face a penalty of 03 - 10 years' imprisonment and liable to a fine of from VND 10,000,000 to VND 50,000,000.
What are the fines for Tarot fortune telling causing disruption to public order in Vietnam?
Pursuant to Clause 1 Article 7 of the Decree 144/2021/NĐ-CP stipulating violations against regulations on public order in Vietnam as follows:
1. A warning or a fine ranging from 300.000 VND to 500.000 VND shall be imposed for any of the following violations:
a) Disrupting order at a place with ongoing art performance, sports activities, commerce, office buildings, residential areas or other public places, except the cases specified in Point a Clause 2 and Point b Clause 5 of this Article;
b) Allowing domestic animals to run off-leash in an urban area or public area;
c) Allowing domestic animals, plants or other items to occupy the road surface, sidewalk, public park, playground, urban area or public area in a residential area or urban area;
d) Unintentionally causing injuries or bodily harm to another person but not liable to criminal prosecution;
dd) Throwing or putting any other item on the perimeter walls and adjacent areas of the protected area;
e) Raising, grazing livestock and poultry in an apartment building
Pursuant to Clause 2 Article 4 of the Decree 144/2021/NĐ-CP stipulating as follows:
2. The fines specified in Chapter II of this Decree are imposed upon administrative violations committed by individuals. The fine imposed upon an organization for the same violation shall be twice the fine imposed upon an individual.
As regulations above, the act of Tarot fortune telling causing disruption to public order in Vietnam shall be fined from 300.000 VND to 500.000 VND.
