Is it Possible to Report via Phone or Facebook?
Article 22 of the 2018 Law on Denunciations stipulates that denunciations can be executed via written complaints or presented directly to a competent authority, organization.
According to Article 23 of the same Law:
- In cases where denunciations are executed via written complaints, the complaint must clearly state the date of denunciation, full name, address of the complainant, means of contact, details of the alleged legal violation, the accused, and any other relevant information. If multiple individuals are denouncing the same matter, then the complaint must also clearly state the full name, address, and contact details of each complainant; and the name of the representative of the complainants.
The complainant must sign or fingerprint the written complaint.
- In cases where the complainant directly presents the denunciation at a competent authority or organization, the recipient shall guide the complainant to write a complaint or record the denunciation in writing and request the complainant to sign or fingerprint the document, detailing the content as stipulated in Clause 1 of this Article. If multiple individuals are denouncing the same matter, the recipient guides the complainants to appoint a representative to write the complaint or record the denunciation in writing and request the complainants to sign or fingerprint the document.
Thus, according to the above regulation, there are two forms of denunciation: via written complaint or directly. If denouncing via written complaint, the complainant must sign or fingerprint the complaint. If denouncing directly, a signature from the complainant is also required on the document. Therefore, denunciations cannot be made via telephone or Facebook.
