Pursuant to Article 3 of the Circular 10/2020/TT-BCA stipulating prohibited items to be brought into prison as follows:

1. Military weapons, hunting rifles, rudimentary weapons, sports weapons and other weapons with similar features and effects; explosive materials.

2. Supporting tools: Guns used to shoot plastic bullets, rubber bullets, tear gas, asphyxiation, poisons, anesthetics, magnetic fields, lasers, flares and bullets used for guns This; all kinds of means of pepper spray, asphyxiation, poison, anesthetic, itch-inducing substances; smoke grenades, tear grenades, explosives; electric batons, rubber batons, metal batons, spikes, spiked wire, armor, electric gloves, knife gloves, bulletproof helmets and other supporting tools.

3. Anesthetics, poisons, inflammables, inflammables, radioactive substances, chemicals, poisons.

4. Narcotic substances, drug precursors, narcotic drugs and psychotropic drugs.

5. Medicines, preventive drugs, functional foods without the consent of the head of the detention facility; alcohol, beer and other stimulants.

6. Metal objects , crockery, stone, glass, thermos and objects that can be used as weapons.

7. Vietnam currency, electronic payment cards, foreign currencies, valuable papers, gold, silver, precious stones, precious metals.

8. Other papers such as: Identity card, citizen identification, passport, household registration, vocational certificate, degree, certificate and other certification papers.

9. Types of personal communication equipment, audio and video recording devices.

10. Uncensored books, newspapers and publications in foreign languages, religions and beliefs; paintings, photos, movies and tapes with superstitious, reactionary and depraved contents; cards, books, newspapers, publications, documents (printed, written) that adversely affect the management and education of prisoners.

11. Other objects that may cause insecurity and insecurity of the detention facility, harm to themselves and others, adversely affect environmental sanitation, or be used for gambling purposes.

Therefore, when sentenced to prison, no one is allowed to wear braces if the braces are made of metal materials.

Pursuant to Article 5 of the Circular 10/2020/TT-BCA stipulating handling of violations as follows:

1. For acts of bringing in, storing or using prohibited objects in prisons with criminal signs, the prison superintendent shall issue a decision to prosecute the case, conduct initial investigation activities, and then transfer them. The investigative agency has the authority to handle according to the provisions of law. For acts of bringing in, storing or using prohibited objects in detention camps or custody houses with criminal signs, the superintendents of the detention camps or detention houses shall make a written request and immediately transfer the violation dossiers. crime and exhibits to competent investigating agencies for handling in accordance with law.

2. Those who detect and denounce acts of bringing in, storing or using prohibited objects in detention facilities to help functional agencies promptly detect and prevent violations, and seize prohibited objects will be commended. Organizations and individuals that assist, cover up, bring in, store or use prohibited objects in detention facilities shall be handled in accordance with law, depending on the nature and seriousness of their violations, .

With this provision, those who detect and denounce acts of bringing in, storing and using prohibited objects into detention facilities and help competent authorities to promptly detect and prevent violations, and seize such prohibited items will be commended.

What are the fines imposed on inmates wearing braces in Vietnam?

Pursuant to Article 6 of the Circular 10/2020/TT-BCA stipulating handling of prohibited objects as follows:

1. Prohibited objects specified in Clauses 1, 2, 3, 4, Article 3 of this Circular shall be recorded in writing and handed over to competent agencies for handling in accordance with law; Prohibited objects specified in Clauses 5, 6, 10 and 11 Article 3 of this Circular shall be destroyed.

2. For prohibited objects specified in Clause 7 Article 3 of this Circular, in cases where the inmate voluntarily surrenders, they shall be kept for storage or handed over to the inmate's relatives at the request. In case of detection and seizure, after fighting and handling violations, these banned objects shall be deposited in the state treasury where the unit is stationed for handling in accordance with law.

3. Prohibited objects specified in Clause 8, Article 3 of this Circular shall be put into storage and returned to inmates after serving the prison sentence.

4. Prohibited objects specified in Clause 9, Article 3 of this Circular, after being seized, must be sealed, kept to clarify the contents of the case and handled in accordance with law.

5. The handling of prohibited objects must establish a handling council. The composition of the Council for handling of prohibited objects in the detention facility is prescribed as follows:

a) The prison's council for handling prohibited objects is chaired by the superintendent; Deputy Superintendent in charge of reconnaissance work as Vice President; Camp Leader, Reconnaissance Team Captain, Guard Team, Education and Records Team, Security - Mobile Police Team, Finance - Logistics Team, Health and Environment Team as members.

b) The detention center's council for handling prohibited objects is chaired by the superintendent; Deputy Superintendent in charge of prison division and management of prisoners as Vice President; Head of camp; Captain of the Staff - Logistics Team (in detention centers with a Reconnaissance Team, the Reconnaissance Team replaces the Staff - Logistics Team as a member), the Medical Team, the Security Police Team, and the Prisoner Team as a member.

c) For the Council for handling prohibited objects of the temporary custody house, chaired by the head of the criminal judgment execution agency of the district-level police office. The captain of the Criminal Judgment Execution and Judicial Assistance Police Team shall act as the Vice Chairman, the officer in charge of the cell and the Security Police shall act as members.

Thus, when detecting braces of a person serving a prison sentence, they will be handled according to the above provisions.
