Is Citizenship Revoked When a Suspended Prison Sentence is Granted?
Article 44 of the Criminal Code 2015 stipulates:
Vietnamese citizens sentenced to imprisonment for crimes of violating national security or other crimes as specified by this Code shall be deprived of one or several of the following civil rights:
a) The right to run for election to the State's power bodies;
b) The right to work in state agencies and the right to serve in the people's armed forces.
The duration of deprivation of certain civil rights ranges from 01 year to 05 years, starting from the date of completion of the imprisonment sentence or from the date the judgment takes legal effect in cases where the convicted person is granted a suspended sentence.
Accordingly, Vietnamese citizens sentenced to imprisonment for crimes of violating national security or other crimes as specified by this Code but granted a suspended sentence are still deprived of one or several of the aforementioned civil rights.
