Inducing Others to Commit Crime: Is It Considered Complicity?

I would like to ask, in the case where Mr. A entices Mr. B to commit a crime, would Mr. A be considered an accomplice? Meanwhile, Mr. A is not the mastermind.

Regarding the principle of complicity, it refers to a case where two or more persons intentionally commit a crime together.

At the same time, Clause 3, Article 17 of the 2015 Penal Code stipulates as follows:

Accomplices include organizers, perpetrators, instigators, and assistants.

- ...

- ...An instigator is a person who incites, entices, or encourages another person to commit a crime.

Thus, even though not the mastermind, if this person entices another to commit a crime, they are still considered an accomplice in the role of an instigator.

Respectfully!
