In Which Cases Is Payment for Granting the Right to Exploit Water Resources Required?
Cases requiring the payment of water resource exploitation rights fees specified in Clause 1, Article 1 of Decree 41/2021/ND-CP. To be specific:
Organizations and individuals granted licenses for the exploitation and use of surface water, groundwater (hereinafter referred to as license holders) in one of the following cases must pay water resource exploitation rights fees:
- For surface water exploitation:
+ Exploiting surface water for power generation;
+ Exploiting surface water for business activities, services, non-agricultural production, including water for cooling machines, equipment, steam generation, and heating.
- For groundwater exploitation:
+ Exploiting groundwater for business activities, services, non-agricultural production, including water for cooling machines, equipment, steam generation, and heating;
+ Exploiting groundwater (excluding brackish water and saltwater) for aquaculture, livestock farming, watering coffee, rubber, cashew, tea, pepper, and other long-term industrial crops with a scale of 20 m³/day and night or more.
