Hello Lawnet. My ex and I broke up half a year ago. Today, on the day of my wedding, suddenly he came and disrupted, forbade me to get married by shouting, smashing at my wedding and threatening to kill me. Will he face criminal responsibility for this act? He also used to cohabit with a woman who is wife of another person. Shall he face criminal responsibility for this act too?

In Vietnam: Will anyone disturbing wedding and obstructing the ex-lover from getting married be liable to criminal prosecution?
Pursuant to Article 181 of the Criminal Code in 2015 stipulating forced marriage or divorce, obstruction of voluntary and civilized marriage, obstruction of voluntary divorce as follows:
Any person who forces another person to marry against his/her will, obstructs another person from marrying or maintaining their voluntary and civilized marriage, forces or obstructs a divorce by means of abuse, mental intimidation, demand for property or other methods despite the fact that he/she has incurred a administrative penalty for the same offence shall receive a warning or face a penalty of up to 03 years' community sentence or 03 - 36 months' imprisonment.
As regulations above, the fact that your ex-lover comes to ruin the wedding, threatens and obstructs you from marriage is considered an act of obstruction of voluntary and civilized marriage.
Therefore, your ex-lover is against the law for "obstruction of voluntary and civilized marriage".
In Vietnam: Will anyone cohabiting with another person's wife be liable to criminal prosecution?
Pursuant to Article 182 of the Criminal Code in 2015 stipulating adultery as follows:
1. Any married person who marries or cohabits with another person, any unmarried person who marries or cohabits with another person in the knowledge that he/she is already married and in any of the following circumstances shall receive a warning or face a penalty of up to 01 year's community sentence or 03 - 12 months' imprisonment:
a) The offence results in the divorce of one or both parties;
b) The offender has incurred an administrative penalty for the same offence.
2. This offence committed in any of the following circumstances carries a penalty of 06 - 36 months'' imprisonment:
a) The offence results in the suicide of the spouse or child of either party;
b) The court has issued a decision on dissolution of the marriage or compulsory termination of the cohabitation but the offender still defies such decision.
As regulations above, if your ex-lover cohabits with another person in the knowledge that he/she is already married resulting in results in the divorce of one or both parties or the suicide of the spouse or child of either party, he shall be prosecuted for adultery in accordance with the law.
In Vietnam: Will the husband maltreating or committing violent acts against the wife be liable to criminal prosecution?
Pursuant to Article 185 of the Criminal Code in 2015 stipulating maltreatment or abuse of one's grandparent, parent, spouse, child, grandchild or caregiver as follows:
1. Any person who maltreats or commits violent acts against his/her grandparent, parent, spouse, child, grandchild or caregiver in any of the following circumstances shall receive a warning, face a penalty of up to 03 years' community sentence or 06 - 36 months' imprisonment:
a) The victim suffers from regular physical and mental pain;
b) The offender has incurred an administrative penalty for the same offence.
2. This offence committed in any of the following circumstances carries a penalty of 02 - 05 years' imprisonment:
a) The offence is committed against a person under 16, a woman with the full knowledge of her pregnancy or an old and weak person;
b) The offence is committed against a person with severe or extremely severe disabilities or a person having a fatal disease.
As regulations above, if the husband maltreats or commits violent acts against his wife, he shall be prosecuted for "maltreatment or abuse of one's grandparent, parent, spouse, child, grandchild or caregiver" in accordance with the law.
