How to Avoid the Death Penalty for the Crime of Embezzlement?

Pursuant to Article 353 of the Penal Code 2015 regarding the Crime of Embezzlement of Property, the highest penalty is death. However, based on Point c, Article 40 of this Code, the following provision applies:

Persons sentenced to death for the crime of embezzlement of property or bribery who, after being sentenced, have actively returned at least three quarters of the embezzled or bribed assets and have actively cooperated with the authorities in the detection, investigation, and handling of crimes, or have made significant contributions.

Therefore, although the embezzlement of property with a large value can be punishable by the death penalty, if after being sentenced, the convict has actively returned at least three quarters of the embezzled assets and has actively cooperated with the authorities in the detection, investigation, and handling of crimes, or has made significant contributions, the death penalty will not be applied in this case.
