Hello, I have this problem that needs to be answered. My husband and I have an unhappy married life. Normally there's just arguing. But on July 23, my husband was drunk and argued with me. He beat me and threw me out of the house. My limbs were scratched and bruised because he beat me amd at that time my son was not home so he couldn't stop him. At around 8pm, my son came home and saw me sitting in front of house. I told him the story, so my son took me to my parents' house. Let me ask, what should I do if my husband beats me and throws me out of house?

According to Article 185 of the 2015 Criminal Code, maltreatment or abuse of one's grandparent, parent, spouse, child, grandchild or caregiver is as follows:

a) The victim suffers from regular physical and mental pain;

b) The offender has incurred an administrative penalty for the same offence.

2. This offence committed in any of the following circumstances carries a penalty of 02 - 05 years' imprisonment:

a) The offence is committed against a person under 16, a woman with the full knowledge of her pregnancy or an old and weak person;

b) The offence is committed against a person with severe or extremely severe disabilities or a person having a fatal disease.

Therefore, in Vietnam, your husband may be criminally prosecuted for beating you and throwing you out of house if the behavior goes beyond the administrative penalty framework.
