How much is fine for illegally using hunting guns to hunt wild animals in Vietnam?

In Clause 4, Article 11, Decree 144/2021/ND-CP stipulates violations against regulations on management and use of weapons, explosive materials, explosive precursors, combat gears, fireworks, firecrackers, and dangerous banned toys as follows:

4. A fine ranging from 10.000.000 VND to 20.000.000 VND shall be imposed for any of the following violations:

a) Illegally manufacturing, providing, storing, transporting, repairing cold weapons or combat gears; parts or assemblies of weapons or combat gears, or explosive components;

b) Appropriating cold weapons or combat gears; parts or assemblies of weapons or combat gears, or explosive components;

c) Illegally manufacturing, storing, transporting, using weapons that have similar functions to hunting guns, cold weapons, sporting weapons or parts, assemblies for manufacture of weapons or combat gears with similar functions;

d) Manufacturing, providing, storing, transporting, repairing, using appropriating hunting guns, parts or assemblies thereof;

dd) Illegally excavating, searching, collecting weapons, explosive materials, combat gears, wastes or scraps thereof;

e) Illegally transporting, storing firecrackers, fireworks, pyrotechnic compositions, materials or components for production thereof;

g) Losing military or sporting weapons;

h) Illegally sawing, cutting or otherwise defusing bombs, mines, bullets, grenades, explosives, naval mines, torpedoes and other weapons;

g) Illegally instructing, training, organizing training in fabrication, production, repair or use of weapons and combat gears in any shape or form.

Thus, in case you are fined for illegally using a hunting gun, you will be fined from 10,000,000 VND to 20,000,000 VND according to the provisions of law in Vietnam.

Can illegally using hunting guns to hunt wild animals face a penalty of imprisonment in Vietnam?

In Article 306 of the 2015 Criminal Code as amended by Clause 108, Article 1 of the Law amending the 2017 Criminal Code, it stipulates illegal manufacture, possession, transport, use, trading or appropriation of hunting rifles, cold weapons, sporting weapons or combat gears:

1. Any person who illegally manufactures, possesses, transports, uses, deals in or appropriates a hunting rifle, cold weapon, sporting weapon or a weapon with similar functions or a combat gear despite the fact that he/she has incurred an administrative penalty for any of the offences specified in this Article or has an unspent conviction for the same offence shall face a penalty of 03 - 24 months' imprisonment.

2. This offence committed in any of the following circumstances carries a penalty of 01 - 05 years' imprisonment:

a) The offence is committed by an organized group;

b) The quantity of the illegal items is large;

c) Illegal goods are transported or traded across the border;

d) The offence results in the death of a person;

dd) The offence causes ≥ 61% WPI for another person;

e) The offence causes a total WPI of 61% - 121% for more than one person;

g) The property damage caused by the offence is assessed at from VND 100,000,000 to under VND 500,000,000;

h) Dangerous recidivism.

3. This offence committed in any of the following circumstances carries a penalty of 03 - 07 years' imprisonment:

a) The quantity of the illegal items is very or extremely large;

b) The offence results in the death of ≥ 02 people;

c) The offence results in bodily harm to ≥ 02 people who suffer from a total physical disability of ≥ 122%;

d) The offence results in property damage assessed at ≥ VND 500,000,000.

4. The offender might also be liable to a fine of from VND 10,000,000 to VND 50,000,000, put under mandatory supervision or prohibited from residence for 01 - 05 years.

According to this Article, in case you illegally use a hunting gun and have been administratively sanctioned in the form of a fine but continue to violate it, you may be sentenced to imprisonment from 03 months to 02 years according to the law in Vietnam.

What is handling for using hunting guns and accidentally shooting someone which results in the death of a person in Vietnam? 

Article 128 of the 2015 Criminal Code stipulates involuntary manslaughter as follows:

1. A person who commits an involuntary manslaughter shall face a penalty of up to 03 years' community sentence or 01 - 5 years' imprisonment.

2. This offence carries a penalty of 03 - 10 years' imprisonment if it results in the death of 02 or more people.

Therefore, in case the illegal use of a hunting gun commits an involuntary manslaughter, the penalty may be community sentence for up to 03 years or imprisonment from 01 year to 05 years. If the act of shooting by mistake results in the death of 02 or more people, the penalty will be from 3 to 10 years in prison in Vietnam.
