How Many Years of Imprisonment for Selling 5 kg of Fresh Opium Fruit?
Based on Article 251 of the Criminal Code 2015 and Clause 68 Article 1 of the Law amending the Criminal Code 2017 regarding the crime of illegal trafficking of narcotic substances:
Any person who illegally traffics narcotic substances shall be sentenced to imprisonment from 02 years to 07 years.
Committing the crime under one of the following circumstances shall be sentenced to imprisonment from 07 years to 15 years:
...
l) Dry opium poppy with a weight from 50 kilograms to less than 200 kilograms;
m) Fresh opium poppy with a weight from 10 kilograms to less than 50 kilograms;
Therefore, in cases where a person illegally traffics 10 kg or more of fresh opium poppy, the penalty frame from Clause 2 shall apply. In this case, the weight of fresh opium poppy does not meet the threshold to apply Clause 2, so a person who illegally traffics 5 kg of fresh opium poppy may be sentenced to imprisonment from 02 years to 07 years (applying Clause 1).
