How Many Years in Prison for an Escape from Jail?
Pursuant to Clause 1, Clause 2, Article 386 of the Criminal Code 2015:
- Anyone who escapes while under temporary detention, temporary custody, escort, trial, or serving a prison sentence shall be sentenced to imprisonment from 06 months to 03 years.
- Committing the crime under one of the following circumstances shall be sentenced to imprisonment from 03 years to 10 years:
+ Organized;
+ Using force against the guard or escort.
Thus, escaping from prison is classified under "Crime of escaping from custody or escaping while being escorted, being tried," and generally, if only escaping, the maximum penalty is 03 years of imprisonment; however, if there is behavior such as using force against the guard or escort or committing the crime in an organized manner, the maximum penalty can go up to 10 years of imprisonment.
