Excavation of Graves to Retrieve Objects May Result in Imprisonment of Up to 7 Years?
Article 319 of the Criminal Code 2015 provides for the crime of violating corpses, graves, and remains:
Any person who digs up, demolishes graves, seizes objects placed in the grave, on the grave, or commits other acts that violate corpses, graves, or remains, shall be subject to non-custodial reform for up to 02 years or imprisonment from 03 months to 02 years.
Committing the crime under one of the following circumstances shall be subject to imprisonment from 02 years to 07 years:
a) Adversely affecting security, order, and social safety;
b) Seizing or destroying objects of historical or cultural value;
c) Acting with a despicable motive;
d) Seizing body parts, remains.
Thus, any person who arbitrarily digs up graves to take objects, assets, or items therein under the above-mentioned circumstances may be imprisoned for up to 7 years.
