Does Watching Gambling Constitute a Crime?
Article 321 of the Criminal Code 2015, amended in 2017, stipulates the offense of gambling as follows:
- Any person who illegally gambles in any form with wins or losses in cash or valuables valued from 5,000,000 VND to under 50,000,000 VND, or under 5,000,000 VND but has previously been administratively sanctioned for this act or for acts specified in Article 322 of this Code, or has been convicted of this offense or the offense specified in Article 322 of this Code, without having their criminal record expunged and commits a violation again, shall be subject to a fine ranging from 20,000,000 VND to 100,000,000 VND, non-custodial reform up to 3 years, or imprisonment from 6 months to 3 years.
...
Thus, if it can be proven that your child did not gamble and only watched, your child will not be criminally liable for the offense of gambling. The police's seizure of the IP 6 and motorcycle in this case is justified; during the investigation and verification of the case, if your child is not found guilty, the property will be returned.
