Does Defamation of Others Lead to Imprisonment?

Article 156 of the Criminal Code 2015 provides for the crime of Defamation as follows:

1. Whoever commits one of the following acts shall be fined from VND 10,000,000 to VND 50,000,000, subject to non-custodial reform for up to 02 years, or imprisonment from 03 months to 01 year:

a) Fabricating or spreading information known to be false to seriously infringe upon the dignity, honor, or cause damage to the lawful rights and interests of others;

b) Falsely accusing others of committing a crime and denouncing them to competent authorities.

Thus, in cases where a person defames, fabricates, or slanders others as outlined above, they shall be subject to criminal liability for this crime. This is the lightest penalty framework for this crime, and those prosecuted may face a minimum imprisonment of 03 months.
