Does a Person Have a Criminal Record for Committing a Very Serious Crime at Age 15?
Article 107(1) of the Criminal Code 2015 provides:
- A person under 18 years old who is convicted shall be considered as having no previous criminal record, if he/she falls into one of the following cases:
a) A person from 14 years to under 16 years old;
b) A person from 16 years to under 18 years old who is convicted of a minor crime, a serious crime or a very serious crime committed unintentionally;
c) A person subject to judicial measures prescribed in Section 3 of this Chapter.
Thus, based on this provision, a person from 14 years to under 16 years old who is convicted, regardless of the crime committed, shall be considered as having no previous criminal record. Therefore, a person who commits a very serious crime at the age of 15 shall have no previous criminal record.
