Do Individuals Who Have Completed a Suspended Sentence Need to Sign a Certificate of Completed Probation?
Clause 4 Article 85 of the Law on Criminal Judgment Execution 2019 stipulates the execution of the suspended sentence decision as follows:
- Three days before the end of the probation period, the commune-level People's Committee, the assigned military unit in charge of monitoring and educating must hand over the monitoring and education dossier to the district-level criminal judgment execution agency, and the military zone-level criminal judgment execution agency.
- On the last day of the probation period, the district-level criminal judgment execution agency, and the military zone-level criminal judgment execution agency must issue a certificate of completion of the probation period.
- The certificate must be sent to the person receiving the suspended sentence, the commune-level People's Committee, the assigned military unit in charge of monitoring and educating, the Court that made the judgment execution decision, the Procuracy at the same level, and the Department of Justice where the Court that made the judgment execution decision is headquartered.
