Do Commune Police Have the Right to Temporarily Seize Weapons from Others?
Based on Clause 3 Article 111 of the Criminal Procedure Code 2015, the regulations are as follows:
- In cases of arresting a person caught in the act of committing an offense, anyone has the right to confiscate the weapons or dangerous items of the person being arrested.
- In cases where the commune-level police, ward-level police, commune-level town police, or Police Station discover, arrest, or receive a person caught in the act of committing an offense, they shall confiscate and temporarily hold weapons, dangerous items, and safeguard related documents and objects. They shall make a record of the arrest, take the initial testimony, protect the crime scene according to the law; and immediately hand over the arrested person or promptly notify the competent Investigative Agency.
Thus, in cases of persons caught in the act of committing an offense, commune-level police have the authority to temporarily hold their weapons related to the criminal act.
