Disposition of a Corpse after Execution when No Relatives Claim the Body: What is the Procedure?
Section 2, Article 60 of the Law on Execution of Criminal Judgments 2010 stipulates:
In cases where the body is not claimed, or when the relatives of the person subject to the execution do not submit a request to claim the body for burial, the provincial-level criminal judgment execution agency of the police or the military zone-level criminal judgment execution agency will organize the burial. After a period of 3 years from the date of execution, relatives or legal representatives of the person executed may submit an application, certified by the commune-level People's Committee where they reside, to request the provincial-level criminal judgment execution agency of the police or the military zone-level criminal judgment execution agency where the execution took place, to claim the remains. The application must clearly state the full name, address of the person claiming the remains, and their relationship with the executed person; a commitment to ensure security, order, environmental sanitation, and bear all costs. Within 7 days from the date of receiving the application, the provincial-level criminal judgment execution agency of the police or the military zone-level criminal judgment execution agency is responsible for reviewing and resolving the request.
In cases where the executed person is a foreigner, the application must be certified by the competent authority or diplomatic representative agency in Vietnam of the country of which the executed person is a citizen and translated into Vietnamese. The resolution of claiming remains is considered and decided by the criminal judgment execution management agency.
