Citizens Disqualified from Running for State Power Agencies Under Which Circumstances?
According to Article 44 of the 2015 Penal Code:
- Vietnamese citizens who are sentenced to imprisonment for crimes that infringe upon national security or other crimes as stipulated in this Code shall be deprived of one or several of the following civil rights:
+ The right to stand for election to State agencies;
+ The right to work in state agencies and the right to serve in the people's armed forces.
- The period of deprivation of certain civil rights ranges from 01 year to 05 years, starting from the date of completing the imprisonment sentence or from the date the judgment takes legal effect in cases where the sentenced person is granted a suspended sentence.
=> Thus, citizens will be deprived of the right to run for election to State agencies when they are sentenced to imprisonment for crimes infringing upon national security or certain crimes as stipulated in this Code. The period of deprivation of civil rights ranges from 01 year to 05 years from the date of completing the imprisonment sentence or from the date the judgment takes legal effect in cases where the sentenced person is granted a suspended sentence.
