Causing Damage When Conducting Experiments, Applying Scientific, Technical, and Technological Advances Still Subject to Criminal Liability?
Based on Article 25 of the Penal Code 2015 stipulating risks in research, experimentation, application of scientific, technical, and technological advancements as follows:
Acts that cause damage during the conduct of research, experimentation, application of new scientific, technical, and technological advancements, although adhering strictly to the procedures and regulations and implementing all preventive measures, are not considered crimes.
Anyone who fails to adhere to the correct procedures and regulations, or fails to implement all preventive measures causing damage, shall still be criminally liable.
Thus, not all acts causing damage during the conduct of research, experimentation, application of scientific, technical, and technological advancements are exempt from criminal liability. In cases of failure to adhere to the correct procedures and regulations, or failure to implement all preventive measures resulting in damage, criminal liability shall still apply.
