Can a 16-year-old who commits murder be sentenced to life imprisonment?
Based on Article 39 of the Criminal Code 2015, the regulation concerning the punishment of Life Imprisonment is as follows:
Life imprisonment is an indefinite prison sentence applied to individuals committing especially serious crimes, yet not severe enough to be sentenced to death.
Life imprisonment is not applicable to individuals under 18 years old who commit crimes.
According to the current criminal law provisions, life imprisonment is not applicable to individuals under 18 years old who commit crimes. This is among the points showing the humanitarian aspect of laws concerning the age of offenders.
Is the death penalty applicable to a 16-year-old?
Based on Clause 2, Article 40 of the aforementioned document, the regulation concerning the death penalty is as follows:
The death penalty is a special punishment applied only to individuals committing especially serious crimes, belonging to one of the groups of crimes that infringe on national security, infringe on human life, drug-related crimes, corruption, and some other especially serious crimes stipulated by this Code.
The death penalty is not applicable to individuals under 18 years old at the time of committing the crime, pregnant women, women raising children under 36 months old, or individuals 75 years old or older at the time of committing the crime or at the time of trial.
Therefore, similar to life imprisonment, the death penalty is not applicable to individuals under 18 years old at the time of committing the crime.
