Are there penalties for leasing out rooms to illegally use narcotic substances in Vietnam?
My brother ran a motel business, the day before the police suddenly broke into the administrative inspection and discovered that a group of people were using narcotic substances in my brother's motel. Will my brother be criminally prosecuted?
Are there penalties for leasing out rooms to illegally use narcotic substances in Vietnam?
Pursuant to Article 256 of the 2015 Penal Code, concealment of illegal use of narcotic substances is as follows:
1. Any person who leases out, lends premises or otherwise conceals the illegal use of narcotic substances, except for the cases in Article 255 hereof, shall face a penalty of 02 - 07 years' imprisonment.
2. This offence committed in any of the following circumstances carries a penalty of 07 - 15 years' imprisonment:
a) The offence involves the abuse of the offender's position or power;
b) The offence has been committed more than once;
c) The offence involves a user aged under 16;
d) The offence involves ≥ 02 users;
dd) Dangerous recidivism.
3. The offender might also be liable to a fine of from VND 50,000,000 to VND 200,000,000 or have all or part of his/her property confiscated.
Thus, according to the above provisions in Vietnam, the person who rents out a place for another person to illegally use narcotic substances is a violation of the law, this act can be prosecuted for criminal responsibility with a penalty of up to 15 years imprisonment depending on the seriousness of the offence. The offenders may also be subject to a fine of between VND 50,000,000 and 200,000,000; confiscation of part or all of the property.
In your case, it is necessary to consider whether your friend knows this group of people who come to rent a room to use narcotic substances or not. If you do not know this, you will not be criminally prosecuted. If your friend knows but still rents out a room to this group of people, he will be prosecuted for criminal liability.
Best Regards!
