Are prisoners exempted from labor on holidays and Tet?
According to Clause 1, Article 32 of the Law on Criminal Judgment Execution 2019, it is stipulated:
Article 32. The Labor Regime for Prisoners
Prisoners are organized to work suitable to their age, health, and in response to the requirements of management, education, and community reintegration. Prisoners engaged in labor must be under the supervision and management of the prison or detention center. The working hours for prisoners shall not exceed 08 hours per day and 05 days per week, with rest on Sundays, public holidays, and Tet holidays as prescribed by law. In cases of sudden or seasonal work, the prison warden may require prisoners to work overtime but not exceeding the total number of overtime hours in a day as stipulated by labor laws. If prisoners work overtime or on rest days, they are entitled to compensatory rest or compensation in cash or in kind.
The prison must implement necessary measures to ensure the safety and hygiene of labor for prisoners.
...
Thus, according to the aforementioned regulation, prisoners serving sentences are exempted from labor on Sundays, public holidays, and Tet holidays as prescribed by law. If prisoners work on these days, they will be entitled to compensatory rest or compensation in cash or in kind.
Respectfully.
