06 Grounds for Prosecution of a Criminal Case

Initiating criminal proceedings is one of the important steps in criminal procedure. Therefore, I would like to ask the Editorial Board: On what grounds do the competent authorities proceed to initiate a criminal case? I look forward to receiving a response soon. Thank you!

Regarding this matter, Article 143 of the Criminal Procedure Code 2015 provides as follows:

An investigation shall only be initiated when there are signs of a crime. Determining signs of a crime is based on the following grounds:

- Reports from individuals;

- Information reported by agencies, organizations, individuals;

- Information reported in mass media;

- Recommendations for prosecution from state agencies;

- Authorities with the power of prosecution directly discovering signs of a crime;

- Voluntary confessions by the perpetrator.

=> Thus, according to this provision, after one or more of the aforementioned grounds are discovered, the competent authority shall proceed with initiating a criminal case.
