In Vietnam, if a person buys a used vehicle from another province, will he/she have to re-inspect it?

I'm live in Nghe An. I bought a car from my relative in Hanoi. I have transferred the car title. May I ask if I need to have the car re-inspected. Thank you.

 

Clause 3, Clause 4, Article 6 of Circular 58/2020/TT-BCA has the following provisions:

- Within 7 days, from the date of documenting the vehicle title transfer from an entity:

+ to another entity in different province or central-affiliated city (hereinafter referred to as inter-provincial title transfer): The vehicle owner shall, in person or authorize another entity to, submit an application form for vehicle registration and the license plate to the competent vehicle registry;

+ to another entity in the same province or central-affiliated city (hereinafter referred to as intra-provincial title transfer): The vehicle owner shall, in person or authorize another entity to, submit an application form for vehicle registration to the competent vehicle registry; if the entity as a buyer, receiver or heir of that vehicle carries out the procedures for vehicle title transfer immediately, the revocation of the vehicle registration certificate is not required.

- Within a period of 30 days as from the date of documenting the vehicle title transfer, the entity as a buyer, receiver, or heir of that vehicle must have their vehicle registered at the vehicle registry to complete the procedures for issuance of vehicle registration and license plate.

Thus, when buying a used car from another province, you must carry out the procedure to transfer the vehicle title: exchange the vehicle registration certificate and license plate.

In accordance with Article 1 of Circular 70/2015/TT-BGTVT, road transport (hereinafter referred to as road vehicles) must undergo inspection of technical safety and environmental protection. This inspection does not apply to motorbikes, mopeds, tractors and other similar vehicles; road vehicles used by military forces and police authorities to serve national defense and security purposes. When a road vehicle passes the inspection requirements, it will be issued a Certificate of Inspection and an Inspection Stamp.

Clause 6, Article 9, Circular 70/2015/TT-BGTVT stipulates that the Inspection certificates and stamps shall become void and null if:

- new inspection certificates and stamps are issued;

- the vehicle owner declares loss;

- the vehicle registry sends a notice of revocation;

- the road vehicle has been involved in accidents so that it fails to meet regulatory requirements relating to the technical safety and environmental protection;

- Actual technical specifications of a road vehicle are not consistent with technical specifications defined in the inspection certificate.

According to this Article, the validity of the Inspection Certificate and Stamp does not affect the transfer of car title to another province.

When you buy a used car from another province, there are 2 cases as follows:

* If the Inspection Certificate and Stamp are still valid: You can continue to use until that period expires without having to re-inspect.

* If the Inspection Certificate and Stamp have expired: You must re-inspect.

Clause 1, Article 5 of Circular 70/2015/TT-BGTVT stipulates that you need to prepare the following documents:

- Present the original vehicle registration certificate, issued by a competent state management agency or one of the following valid papers such as a copy of vehicle registration certificate certified by safekeeping banks; a copy of vehicle registration certificate certified by finance leasing organizations; an appointment paper for grant of vehicle registration certificates.

- Present the original valid certificate of insurance for civil liability of motor vehicle owner.

- Submit documentary evidences of vehicle origin, including one of the following papers: a copy of factory quality inspection note for motor vehicles produced, assembled domestically; authenticated copy of decision on confiscating for auction of competent authorities for motor vehicles which are confiscated for auction; authenticated copy of decision on liquidation for motor vehicles of defense, public security force; authenticated copy of decision on sale of national preserved vehicles.

- Submit the original certificate of technical safety and quality and environment protection of refurbished road vehicles (required only for newly-refurbished motor vehicles).

Inspection of road vehicles is carried out at any inspection unit across the country.
