Can a Person Who Is Incapable of Civil Acts Deposit Savings?
Article 3 of Circular 48/2018/TT-NHNN stipulates on depositors for savings as follows:
- Vietnamese citizens who are 18 years old or older with full civil act capacity as prescribed by law.
- Vietnamese citizens who are from 15 years old to under 18 years old and not restricted in civil act capacity or not losing civil act capacity as prescribed by law.
- Vietnamese citizens who are restricted in civil act capacity or losing civil act capacity as prescribed by law or under 15 years old conduct savings deposit transactions through their legal representatives; Vietnamese citizens with cognitive difficulties and poor control over their behavior as prescribed by law conduct savings deposit transactions through their guardians.
Thus, persons who have lost their civil act capacity can still deposit savings through their legal representatives.
